The explosion of social media over the past 20 years has been a both a boon and a curse for artists. With the benefits of global access and inspiration have come drawbacks. Inspiration can lead to infringement, major companies poach artwork for their advertising, and the urban legends of copyright have been given new life by Facebook “legal” posts.
This presentation will begin with a look at how access leads to both accidental and intentional infringement. Next, a brief overview of general copyright and trademark principles, rights and remedies will offer a base level for discussing intellectual property rights under common social media user agreements (Facebook, Instagram). Finally, two recent cases of alleged infringement will be analyzed in terms of pitfalls and best practices for artists.
